General Agreement

This Short-term Vacation Rental Agreement is comprised of the terms and conditions and agreement between the EireKnP Host and the Guests renting temporary use of the EireKnP property.

The Property

The Host agrees to rent the following described property to the Guest for their temporary use, and the Guest agrees to rent the following property from the Host, for the term specified below in VACATION RENTAL TERM:

Parking: One vehicle (Note: will accommodate a toy trailer as applicable)

Cell Service: Rogers Cellular serves this area

Reservation and Security Deposit

The Guest shall be obligated to pay the following reservation and security deposit upon execution of this Agreement:

To secure your booking, a refundable reservation and security deposit of $200 is required via cash or e-transfer. The deposit will be returned in cash or e-transfer within three days of checkout, provided check out times are met, occupancy limits are observed, there are no damages or loss, no excessive cleanup, and no violations of this agreement.

EXCESSIVE CLEANUP. If the Property qualifies for a “deep clean” due to excessive wear and tear from your Rental Term, a fee of $125.00 (“Excessive Cleanup Fee”) shall be charged at the end of the Rental Term. The Excessive Cleanup Fee may be deducted from the Security Deposit, provided there are no other violations to this agreement.

CANCELLATIONS: Cancellations are free up to Seven (7) days before rental check-in date. If for any reason you cancel after the Seven day deadline, a $50.00 service fee will be deducted from the deposit before it is returned.

OCCUPANCY LIMIT. The total number of individuals staying on the Property during the Rental Term shall be a total of two (2) guests. One child (under 18) can be accommodated on a host-provided cot, for an additional fee of $50 per night. The rental rate is based on this maximum occupancy. Based on representations by the Guest, this Rental Term will consist of the following occupants:

  • One Adult
  • Two Adults
  • One Adult and One Child
  • Two Adults and One Child, with Host approval and accommodation, and additional fee

Occupancy exceeding the number of guests listed above is a breach of this Agreement and may be subject to termination by the Host with no refund of monies.

Note: if the Property is damaged, destroyed, uninhabitable, or is unavailable for any other reason, the Host may terminate this Agreement by giving written notice to the Guest. All payments that the Guest has made will be refunded, and the Host will not bear any further responsibility towards the Guest.

Payment

The Guest shall pay the Host 50% of the total amount owing at the time of booking, plus the Reservation and Security deposit of $200.00. The remaining 50% is due one week prior to occupancy.

General Terms and Conditions

Subletting: The Guest shall not sublet the Property.
Utilities: The Host shall be responsible for all utilities and services to the Property, including: electricity, water, and Wi-Fi.
Trash Disposal: The Guest is required to take their trash and recycling with them upon departure, or alternatively, leave trash bagged and tied in the deck box, and use the provided recycling bin(s).
Parking: The Host shall provide parking for one (1) vehicle and will accommodate boat/Ski-Doo/ATV trailers as required.
Keys: The Guest will Self Check-in using a Key Code provided by the Host.
Inventory and Amenities: Please see below for inventory and amenities. Please refer to www.EireKnP.com for the most current cabin inventory and amenities. All items may be used by the Guest during the Rental Term and are subject to the terms and conditions set forth in this Agreement.
House Rules: Please see below for additional house rules as well as details regarding the Check-in and Check-out process.
Host Entry: The Host has the right at all reasonable times during the terms of this Agreement to enter the property if necessary for the purpose of inspection, repair or any other reasonable action. Unless an emergency, notice will be provided in accordance with applicable Ontario law.
Maintenance and Repairs: The Guest shall maintain the Property in a good, clean, and “ready-to-rent” condition and use the Property in a careful and lawful manner and in accordance with the entirety of this Agreement. The Guest shall leave the Property in a “ready-to-rent” condition upon checking out, meaning that the Property should be immediately habitable by future guests. Should the property not meet these conditions, the Guest shall be responsible for paying for any maintenance and repairs. The Guest agrees that the Host shall deduct costs of said services from the Security Deposit prior to a refund if Guest causes any damage to the Property or any items listed on the current cabin inventory.
Water and Septic: The property is on a well, with a grey water and holding tank septic system. The Host, therefore, asks that you limit showers, and that natural waste and toilet tissue are the only things allowed down the drains.
Quiet Environment: The Guest, along with neighbors, shall enjoy each other’s company in a quiet and respectful manner. The Guest is expected to behave in a respectable manner and shall be a good neighbor to any residents within the immediate area. Creating a disturbance of the area by violation of Quiet Hours, unauthorized gatherings, or any inappropriate conduct shall be grounds for immediate termination of this Agreement.
Quiet Hours: During the Rental Term, and for the comfort of neighbors, the Guest agrees to abide by the following terms: Quiet hours begin at 10:00pm each night and continue until 9:00am the next day. Quiet hours consist of no loud noise/music and keeping all noise at a minimum level.

LIABILITY

Host Liability: The Guest and any of their occupants hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Property, including fishing boat rental. The Guest expressly recognizes that any insurance held by the Host does not cover the personal property of Guest and that Guest should purchase their own insurance for their party if such coverage is desired.
Guest Liability: The Guest is liable for their own acts and the acts of anyone listed in this Agreement in addition to any occupant the Guest happens to invite/allow on the Property.
Attorney’s Fees: The Guest agrees to pay all reasonable costs, attorney’s fees, and expenses that result from the Host enforcing this agreement.
Use of Property: The Guest shall use the Property for residential purposes only. The Guest is explicitly prohibited from engaging in any commercial activity on the property.
Illegal Activity: The Guest shall use the Property for legal purposes only. Any illegal use, including but not limited to, illicit drug use, verbal or physical abuse of any person or illegal sexual behavior shall be cause for immediate termination of this Agreement with no refund of security deposit.
Guest Possessions: Any personal items or possessions that are left on the Property are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest at the Guest’s expense. If claims are not made within One Week after the end of this agreement or notification by the Host of Guest property, the Host shall repurpose or discard said items.
Hazardous Materials: At the Property, and without notifying the Host in writing, the Guest shall not possess any items that may be considered a fire hazard, other than items for cooking or the operation of an appliance. These items include, but are not limited to, gasoline, compressed gas, propane, kerosene, motor oil, fireworks, ammunition, or any other similar item whether in the form of a liquid, solid, or gas.
Refunds: The Host shall not provide a refund due to a shortened stay and/or poor experience that resulted from unfavorable weather conditions, an Act of God, or anything outside the control of the Host.
Joint and Several: If there is more than one Guest, all Guests shall be jointly and severally liable under this Agreement.
Governing Law: This Agreement shall be governed and subject to the laws of the Province of Ontario, Canada.
Waiver: A delay or failure by the Host to enforce any section of this Agreement shall not be deemed as a waiver of any violation. In addition, acceptance of any partial payment of rent, or any other amount due, shall not be deemed a waiver of the Host’s right to the entire amount set forth in this Agreement.
Additional Provisions: Additional provisions can be added by the Host to this agreement depending on the rental circumstances.
Entire Agreement: This Agreement contains all of the terms and conditions agreed to by the parties. It may only be modified or amended by written agreement, and signed by all parties to this Agreement. This Agreement replaces all previous discussions and agreements, whether oral or written. The Parties agree to all terms and conditions of this Agreement and shall be bound until the termination of the Agreement.
Amenities and Inclusions: Following are the amenities and inclusions to this Short-Term Vacation Rental Agreement:

i. Fully self-contained riverfront cabin on the Mississippi River at Snow Road Station in North Frontenac
ii. Queen Size Murphy Bed sleeps 2, and we supply linens, pillows and comforter
iii. Living room has two swivel recliners with ottomans, plus 32” SMART TV, and Wi-Fi included
iv. Efficient kitchen with appliances including fridge, stove, microwave, toaster oven, tea kettle, Single Cup Drip Coffee Maker, Single Cup Keurig Coffee Maker, pots and pans, cooking utensils, knife block, dishes, flatware, kitchen towels, dish soap; we supply salt and pepper, condiments and olive oil; you bring the rest
v. Dining Room has a table and two chairs
vi. In the bathroom, we supply hand soap, bath towels, hand towels, and face cloths, hair dryer, plus two beach towels; bring your own shampoo, body wash etc.
vii. Air Conditioning and Electric Heat, as well as a cozy wood stove (firewood provided)
viii. All windows have new blinds for privacy
ix. New 200 sq ft deck with new deck furniture and deck box for Guest use
x. Games, playing cards, and books available
xi. Brand new BBQ and utensils
xii. Two seater paddle boat available for use
xiii. Parking for you and toy trailer
xiv. Fire pit
xv. Groceries, supplies, Beer Store, LCBO, etc. is a short drive away in Perth or Sharbot Lake ON

House Rules

i. EireKnP resides in the Palmerston Highlands Community which has communal properties owed and maintained by the residents of the community. Guests of EireKnP are therefore not permitted to use the common properties, nor the chattels on said properties. Please discuss this rule with the Host if you have any questions.
ii. No pets.
iii. No fireworks.
iv. No additional tents or other accommodations onsite.
v. No smoking in the Cabin. Smoking is allowed outside. Do not leave remnants of smoking on the property.
vi. Do not leave garbage outside as the wildlife will have a field day with it. Use the deck box provided.
vii. Nothing down the drains, except natural solids and toilet paper.
Check-In Process
I. Guests may check-in after 3:00pm, but before 8:00pm.
Check-Out Process
i. Guest must Check-Out by 11:00am; depending on availability or previous bookings, a late departure can be arranged for an additional fee.
